PROCESS FOR REGISTERING A DESIGN PATENT

The process for registering a design patent consists of the 2 following steps:

     1 - Design patent search in the United States
     2 - Registering a design patent in Canada and the U.S.

In the case of an industrial design patent, our opinion is that a search in the United States is perhaps sufficient since the majority of those patented in Canada are also patented in the US. The magnitude and commercial potential of the American market explain this phenomenon to a large extent.

The cost of this package is $2760 + taxes and includes:

• the fee for opening your file
• a design patent search in the United States
• filing for industrial design patents in Canada and the United States
• taxes required by the Canadian and American patent offices

Attention:  If you already have your own technical drawings which comply with requirements of the patent offices, your fee will be deducted by $400.
